TERMS OF PAYMENT

The payment methods accepted on OVYE are:

All transactions take place through the Paypal circuit, to which you will be redirected at the time of purchase, without the need for further registration.

OVYE uses an SSL encryption system that guarantees the confidentiality of information transmitted via the Internet.

VAT is already included in the price shown in the product sheet.

SHIPPING METHODS

Orders containing items marked “AVAILABLE ON ORDER” require more processing time and will be shipped within 15 days.

Orders containing items marked “AVAILABLE” received by 12.00 am will be shipped the same day and delivered to the client within 2 working days (In Italy), from 3 to 7 working days (within the EC), outside the EC the shipments are sent by DHL pls ask for infos.

During sales, promotions and launch of new products will be shipped in approx 7 to 10 working days starting from the order confirmation, plus the delivery times as above.

The shipping cost in Italy is € 5,00, FREE for purchases starting from € 100 (only in Italy)

We invite you to check that the shipping address is correct: it is not possible to change it once the order is completed, unless contacting the courier, additional costs due to inexact address given by the customer are on customer’s account.

REGISTRATION

Once registered on OVYE you can:

– Access the site with your profile
– Keep your cart memorized for 1 hour once the order is confirmed, before making the payment
– Skip the registration process when ordering
– Modify your personal data
– Your orders will be saved in the ORDER HISTORY section.

Bank details are not requested during registration but directly at the time of payment from the PayPal circuit.

RETURNS AND REFUNDS

In effect since 31.10.2018

The products can be returned within 14 days of purchase provided they have not been damaged or used, the products must be returned to Ovye srl, Blocco 1, via dei Pellicciai Centergross 40050 Funo di Argelato (BO), upon email notification to supportoclienti@ovye.it, which informs you that you wish to exercise the right of withdrawal. The right of withdrawal is not valid outside the EC, goods shipped outside EC cannot be returned for any reason (exept production defects).

For products received defective or incorrect  we will collect them with our couriers and we will replace the product without additional costs.

For returned products for your decision, the choice of courier and the related cost are your responsibility. Upon receipt of the returned goods, after having checked the conditions, the original amount spent is credited less the management costs which amount to 5.00 euros.

For returned products to change size, we will send the courier to your home to pick up the product and we will send it to you again for 12 euros (only within Italy) in the EC you will send them with your own courier and before the shipment of the replacement another shipment will be charged.
Products can only be changed once, products already replaced for size change can no longer be returned.

TERMS OF SALE

1. OBJECT

1.1. These online General Terms and Conditions of Sale (hereinafter “GTC”) govern the contract (hereinafter “CONTRACT”) for the sale of products exclusively marked with the OVYE brand (hereinafter “PRODUCTS”) offered by OVYE SRL (hereinafter ” OVYE ”) – through the website shop.ovye.it (hereinafter” SITE “) owned by OVYE SRL to the users of the SITE (hereinafter” CUSTOMER “or” CUSTOMERS “).

1.2. In the present GCS the term CLIENT or CUSTOMER means the “consumer” or the “consumers” as per article 3, co. 1, lett. a), of Legislative Decree 6 September 2005, n. 206 (hereinafter “CODE”), ie “the natural person who acts for purposes unrelated to any entrepreneurial or professional activity performed”.

2. EFFECTIVENESS AND MODIFICATION OF THE GCS

2.1. The GCS are available on the SITE to be easily read by the CUSTOMER before registration and before making the purchase of the PRODUCTS; are considered accepted together with the registration and the submission of the purchase order form, and can be stored on the CUSTOMER’s computer and reproduced on paper by printing the file in which they are contained.

2.2. The GTCs applicable to the sale of the PRODUCTS are those published on the SITE, on the date of the order relating to the PRODUCTS. The CUSTOMER, therefore, will have to view the GCS, whenever it intends to proceed with a purchase on the SITE.

2.3. The mere tolerance or non-contestation by OVYE of any default by the CUSTOMER with respect to the contents of the GCS cannot be interpreted as a tacit acceptance of such defaults, nor as a desire to derogate from what was agreed between the parties

3. REGISTRATION AND PURCHASE PROCEDURE

3.1. The CUSTOMER who intends to proceed with the purchase of the PRODUCTS must express this desire through the registration of his data and a request made directly on the SITE where, following the purchase procedure indicated therein, he will forward the electronic order of his electronic order purchase (hereinafter “ORDER”) and the related payment. The customer must keep the access credentials to the site in a strictly confidential manner because their unjustified communication to third parties, in case of transmission by them, of a purchase order via the SITE, will engage the customer to pay the price.

3.2. The order form contains a summary of information on the essential characteristics of each product ordered and the relative price (including all applicable taxes and fees), the chosen means of payment, the delivery methods for the products purchased and the costs of shipping and delivery: before sending the ORDER, the CUSTOMER must carefully read the entire contents, identify and correct any data entry errors.

3.3. All the purchase orders of the PRODUCTS are subject to their availability and, therefore, to the confirmation of OVYE, which will communicate this availability by sending an e-mail to the ORDER CONFIRMATION CUSTOMER. Only by sending this email will the contract be concluded and perfected.

3.4. In case of failure to execute the ORDER, due to unavailability of one of the PRODUCTS ordered, OVYE will inform the CUSTOMER via e-mail and ask for confirmation of the CUSTOMER’S ORDER, for the purchase of any remaining PRODUCTS ordered and available. In any case, the unavailability of one or more of the ordered PRODUCTS does not automatically imply the cancellation of the totality of the ORDER, which remains at the discretion of the customer, subject to communication.

3.5. The AGREEMENT between the CUSTOMER and OVYE (OVYE SRL) is governed by the ORDER, the SHIPMENT CONFIRMATION, the GCS and the Privacy Policy (hereinafter “PRIVACY”) both published on the SITE

4. OVYE SRL

4.1. MOVYE, in the person of its legal representative Longhi Claudio, undertakes to deliver the PRODUCTS to the address indicated by the CUSTOMER in the ORDER. OVYE will not be liable for delivery errors due to inaccuracies or incompleteness in completing the customer or ORDER data sheet or because the CUSTOMER cannot be contacted. Delivery is made by express courier, therefore mailboxes cannot be accepted.

4.2. In the event of total or partial return of the PRODUCTS under the right of withdrawal, OVYE, in accordance with the provisions of article 9, will only reimburse the sum, equal to the value of the goods net of management costs returned.

5. RIGHTS AND OBLIGATIONS OF THE CUSTOMER

5.1. The CUSTOMER is the only person responsible for the truthfulness of the data and for the correctness of the information provided to OVYE during registration through the SITE and undertakes to promptly communicate any changes to the data entered.

5.2. The CUSTOMER, when registering and sending the ORDER, declares to have read, understood and accepted the GCS and the additional information contained on the SITE including the PRIVACY.

5.3. The CUSTOMER undertakes, once the purchase procedure on the SITE is completed, to provide for both the saving of an electronic copy and the printing of the ORDER and of the GCS for the purpose of their preservation, as indicated in the previous article 2

6. USE OF THE SITE

6.1. The essential characteristics of the PRODUCTS are presented on the SITE within each product page. The images and colors of the products offered for sale on the SITE may not perfectly correspond to the real ones due to the Internet browser and the monitor used when connecting to the SITE.

6.2. OVYE assumes no responsibility for problems caused to the CUSTOMER by the use of the SITE and the technologies used as they do not depend on its own will, such as, for example: a) errors, delays or inability to access the SITE by the CUSTOMER during the execution of the sales procedure; b) errors, delays or impossibility in the receipt by the CUSTOMER of communications made by OVYE in relation to the sale of the PRODUCTS.

6.3. In any case, OVYE undertakes, as far as possible, to resolve the problems that may occur and offer the necessary assistance to the CUSTOMER to obtain a rapid and satisfactory solution to the aforementioned problems.

7. PRICES AND PAYMENTS

7.1. The prices of the PRODUCTS are those actually displayed on the SITE at the time of issuing the ORDER and, unless otherwise specified, are Italian VAT included, is not possible to issue invoices without vat or with the vat of the destination country (also for non EC shipments). At the prices shown on the SITE, for each of the PRODUCTS, the shipping and delivery costs must be added, which will be duly highlighted and summarized before the ORDER is issued and subsequently also in the ORDER CONFIRMATION.

7.2. The total price for the purchase of the PRODUCTS and the shipping costs, as indicated in the ORDER, will be charged to the CUSTOMER when making the payment.

8. DELIVERY OF THE PRODUCTS TO THE CUSTOMER

8.1. Upon delivery of the PRODUCTS to the CUSTOMER by the carrier assigned to transport them, the CUSTOMER must check: a) that the quantity and type of PRODUCTS ordered corresponds to what is indicated in the transport document; b) that the packaging used for transport is intact, not damaged, wet or otherwise altered, even only in the closing materials.

8.2. Any anomalies must be immediately reported to the carrier upon receipt of the PRODUCTS, by indicating them on the delivery note. The CUSTOMER can write an e-mail to supportoclienti@ovye.it in order to facilitate and speed up the control procedure for any anomalies by OVYE.

9. RIGHT OF WITHDRAWAL

9.1. The CUSTOMER has the right to withdraw from the contract concluded with OVYE, within 14 days starting from the day of receipt, of the PRODUCTS purchased on the SITE, provided that the products to be returned are intact, never worn, complete with their own packaging, tags and of the original labels. No withdral right is allowed for non EC shipments.

9.2. In case of exercising the right of withdrawal, even partial, the return of the PRODUCTS must be made in a single solution.

9.3. If the CUSTOMER intends to exercise the right of withdrawal referred to in this article, he must: – send an e-mail to the address supportoclienti@ovye.it, attaching the SHIPMENT CONFIRMATION sent by OVYE and specifying in the text of the e-mail mail the numeric code of the item or items to be returned and the reason for the return, contact the courier in the manner indicated by OVYE and send, within the following 14 days from the e-mail communication of the withdrawal, the products to be returned to the address written on the waybill.

9.4. All the PRODUCTS are in a box with an identification label, their own packaging. OVYE, in case of exercising the right of withdrawal of the CUSTOMER, has the faculty not to accept the return of the RETURNED PRODUCTS that are lacking of its own packaging, of the relative label and that have been used, worn, washed, damaged or altered in their essential characteristics and qualitative.

9.5. If the right of withdrawal is exercised in accordance with the methods and terms described in this article, OVYE will, as soon as possible, send to the CUSTOMER, via e-mail, the relative confirmation of acceptance of the RETURNED PRODUCTS and to reimburse, through a banking procedure, the amount spent on the product (Return and handling costs excluded).

9.6. In any case, the cash return method is prohibited.

10. PROTECTION OF PERSONAL DATA

10.1. OVYE guarantees to the CUSTOMER that the personal data acquired in connection with the sale of the PRODUCTS will always be processed lawfully and correctly, in full compliance with the provisions of Legislative Decree 30 June 2003, n. 196 (hereinafter “DECREE”) in accordance with the contents of the PRIVACY, published on the SITE and printable.

10.2. For any information concerning the processing of personal data, please refer to the information on the processing of data provided by OVYE, pursuant to art. 13 of the DECREE, to the CUSTOMER at the time of registration on the SITE. Please note that the CUSTOMER, in case of need for further clarifications regarding the processing of personal data (article 7 of the DECREE) can contact OVYE directly online (www.ovye.it/privacy-policy/) or at the following address info@ovye.it.

11. COMMUNICATIONS

For any assistance or complaint regarding the purchased PRODUCTS, the CUSTOMER may contact OVYE at the following email address: info@ovye.it.

12. APPLICABLE LAW AND JURISDICTION

The GCS are governed by Italian law and in particular by the CONSUMER CODE and by the legislative decree 9th April 2003 n. 70 in relation to some peculiarities of electronic commerce.

WITHDRAWAL

The purpose of OVYE, a service offered by OVYE SRL (“the Seller”) is to guarantee your complete satisfaction. If for some reason you are not satisfied with your order you can exercise your right of withdrawal within 10 working days from the day you received the products purchased on shop.ovye.it. The products can be returned by shipping the package via the courier indicated by the Seller, or by another courier, only after contacting OVYE by writing an email to supportoclienti@ovye.it.

RULES FOR EXERCISING THE RIGHT OF WITHDRAWAL

The right of withdrawal is considered exercised correctly if the following conditions are fully met: the request for authorization must be correctly completed and sent to OVYE within 10 working days from the delivery date. The communication can be sent, within the same term by registered letter to the Seller’s address (OVYE).

The products must not have been used, worn or damaged; the identification label must still be attached to the products; the products must be returned in their original packaging; returned products must be sent to the Seller in a single shipment. The Seller, in fact, reserves the right not to accept products of the same order, returned and shipped at different times. We will try to authorize you to return the product / order on the same day you make the request, otherwise the next business day, from Monday to Friday (excluding holidays). In the authorization e-mail there will be details on the shipping methods. Returned products must be delivered to the courier chosen within 10 working days from the date we authorized your return. If you have complied with all the required conditions, the Seller will reimburse you, through a banking procedure, the costs incurred by you for the purchase of the products (expenses for returns and for management are excluded).

TIMES AND REFUND METHODS

After the Seller has received your return and checked that all the requirements have been respected,. Whatever the method of payment used by you, the rembursement is activated by the Seller as soon as possible, and in any case within 14 working days from the date on which it became aware of the exercise of your right of withdrawal, once verified that the withdrawal has occurred in compliance with the above conditions. The actual time for the re-credit or the return of the amounts you paid for the purchase of the products depends on the payment methods used: purchase by credit card: upon acceptance of the return we will require our bank to make the repayment on your maximum credit card within 14 working days. From this moment, the time required to display the amount in your account will depend on the institution that issued your card, but normally takes place within two statements. All products offered for sale by the Seller carry an identification label, which is an integral part of the goods. We invite you to try the product without removing the label because the returned products that are not will be accepted
